Terms of Service

These Terms of Service (“Terms”) govern your access to and use of all our products & services across our Branches and subsidiaries including our various websites and across all platforms utilized by the parent company Mack IV Consult which may be regarded as ‘we‘, ‘ us‘, ‘our‘ and “The Institute” for the sake of these terms.  By using the Services, you agree to be bound by these Terms in their entirety.

Please note that these stipulated Terms are listed in Points and are subject to frequent reviews, and updates and there may or may not be prior notice to these effects.

Examination Registration & Training Services

Points:

  1. Exams or Tests can only be registered when full payment is made and confirmed by the Institute. Part Payment for any Examination or Test registration will not be considered until payment is complete.
  2. For most exams the Institute offers, we register Candidates collectively or in batches with preference given to the closest chosen month of that exam. This in turn may give candidates enough time to make exam scheduling changes at no cost. Hence, Tests that have been successfully registered correctly will not be canceled by us.
  3. Where a Candidate first preferred Test date is no longer available, he or she will be automatically registered for his or her second preferred Test date if already chosen by the Candidate; and may or may not be contacted upon this action. Where the candidate has no second preferred exam date, the candidate will be registered for the closest exam date to the first preferred exam date.
  4. In a situation where a candidate’s Test isn’t registered due to the non-availability of chosen preferred date(s), such person will be contacted by the Institute to pick an alternatively available date via E-mail, Phone call, or SMS for which we must receive mutual correspondence.
  5. Where the candidate does not accept the above (point 4), the option of a refund becomes available after which all charges for Textbooks and Training services have been deducted.
  6. We will consider requests in writing (via E-mail) for refunds of unregistered Tests or Examinations on a case-by-case basis via the receipt of relevant information to determine the eligibility of a refund. Where eligible, (point 5) applies including a 10% Service Charge. Where it is established that the warranted service paid for was not provided due to our incapacity, the 10% service charge will be waived.
  7. Refunds will not be issued for incorrect choice of examination or test. However, there is an option of Examination conversion (points 5 and 15) applies.
  8. Payment made for Training services is NON-REFUNDABLE and NON-TRANSFERABLE.
  9. Switching of Training schedules or modes (from Weekdays to Weekends) or vice versa is permitted on the basis that the Candidate informs an admin staff of their intent and that the Candidate is made aware that their training duration will not be extended or adjusted to suit their newly chosen Training Schedule.
  10. Candidates must inform at least one admin personnel if or when the Candidate plans on being absent from their scheduled Training duration. Failure to do so would result in the client forfeiting days missed and would not be entitled to an extension of Training duration.
  11. Candidates are restricted to the Training schedule or mode paid for. Mixing of Training schedules is not permitted.
  12. In a situation whereby a Candidate makes a part payment for an Examination or Test and an upward price review occurs before the balance of payment, such candidate would have to make the balance payment on the new pricing.
  13. In a case where a candidate has made full payment for an exam and an upward price review occurs, such candidate will be contacted either to make a balance payment or be given the option of a Refund (points 5 and 6 apply).
  14. In the eventuality, a candidate could not be registered or service could not be fulfilled due to circumstances beyond our control, (Exam body-related, voucher unavailability, etc.) such candidate would be contacted, be made aware of the issue, and would be given alternative options to choose from including the choice of applying for a Full Refund (Point 5 applies).
  15. There will be no refund for an Examination or Test registration payment that has exceeded one Fiscal Year (12 months from the time of one's Payment). Such Examination or Test MUST be taken by the Candidate or Payment made will be forfeited.
  16. Application and Payment (A rescheduling fee will be charged) for Test Rescheduling must be made within our stipulated deadlines with respect to your PREVIOUSLY chosen test date.
  17. Candidates are advised to register and make payment for their intended examination(s) at least 2 weeks from their preferred examination date depending on the availability of the said date. Extra charges may apply to Certain exams with Late Registration cases (Registrations done within 7 days or less to one's chosen exam date) or Candidates may be given the option of choosing a further exam date.
  18. Payment made by a candidate without requesting service will lead to forfeiture after a maximum of two (2) years.
  19. Failure to Reschedule a candidates' examination will result in a Refund if said candidate did not pay the required rescheduling fee on or before our established deadline (number of days before the ‘to be rescheduled' exam date) for that particular Examination.
  20. Though we use several means of communication or correspondence in interacting with Candidates or Clients, the most acceptable form of correspondence from Test Candidates or Clients to Mack iv Consult and (or) its subsidiaries in the E-mail. Every update or request from Candidates pertaining to our services must be sent via E-mail even if previous correspondence may have occurred through other means of communication. This helps both parties have a record of previous correspondence and acknowledgments. We will always ask Candidates to send E-mails pertaining to their requests before acting on them.
  21. If a candidate goes against our terms and cancels an Exam directly with the respective examination body (point 2 refers), We reserve the right to claim a 25% service charge of whatever is refunded after the exam body may have deducted their own service charge.

As a Test / Exam registration agency, we are bound by the terms of service and policies of each individual Exam or Test body we work with. This, therefore, means that Test Candidates who register through us, respective of their chosen Examination(s) Test body, are by default, bound to the Terms of Service, Testing Policies, and Privacy policies of the respective Test Bodies they choose to work with through us.


Payment 

Payments made via Bank Transfer to our stipulated bank account(s) need to be confirmed by our Accounting Dept, always follow the instructions specified concerning payment confirmation to receive receipts for the transaction paid for.
To enable fast and efficient payment processing for the Institute customers, we have included secure 3rd party payment gateway processor(s) by Payment Service Providers on our websites where payments are to be received.

Terms of Online Payment via Payment Gateway(s)

In case the Website or Payment Service Provider’s webpage, which is linked to the Institutes Website, is experiencing any server related issues like ‘slow-down' or ‘failure’ or ‘session timeout’, the User shall, before initiating the second payment, check whether his/her Bank Account has been debited or not and accordingly resort to one of the following options:

  • In case the Bank Account appears to be debited, ensure that he/ she does not make the payment twice and immediately thereafter contact the Institute via e-mail or any other mode of contact as provided by the Institute to confirm payment. If payment cannot be confirmed by the Institute, the institute will contact the Payment Service Provider(s) on your behalf to find a possible resolution.
  •  In case the Bank Account is not debited, the User may re-initiate payment.
  • Successful payment via the payment gateway will issue a payment receipt for the transaction by the Payment Service Provider. This receipt by the Payment Service Provider is not equivalent to the receipt of the Institute. After a successful payment, two receipts are sent. One from the Payment Service Provider and the other from the Institute which is automated. If the Customer does not receive a receipt from the Institute, the Institute should be contacted for follow-up immediately as the Institute's receipt (A MACK IV CONSULT RECEIPT) is the only valid proof of Payment and Registration confirmation acknowledged.
  1. The Institute and the Payment Service Provider(s) assume no liability whatsoever for any monetary or other damage suffered by the User on account of:
  • The delay, failure, interruption, or corruption of any data or other information transmitted in connection with the use of the Payment Gateway or Services in connection thereto; and/ or
  • Any interruption or errors in the operation of the Payment Gateway.
  1. The User agrees, understands, and confirms that his/ her personal data including without limitation details relating to debit card/ credit card transmitted over the Internet may be susceptible to misuse, hacking, theft, and/ or fraud and that the Institute or the Payment Service Provider(s) have no control over such matters.
  2. Although all reasonable care has been taken towards guarding against unauthorized use of any information transmitted by the User, the Institute does not represent or guarantee that the use of the Services provided by and through it will not result in theft and/or unauthorized use of data over the Internet.
  3. The Institute, the Payment Service Provider(s), and its affiliates and associates shall not be liable, at any time, for any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communications line failure, theft or destruction or unauthorized access to, alteration of, or use of the information contained on the Website.
  4. The User may be required to log in with his/ her own User ID and Password, given by the Institute in order to register and/ or use the Services provided by Institute on the Website. By accepting these Terms and Conditions the User agrees that his/ her User ID and Password are very important pieces of information and it shall be the User’s own responsibility to keep them secure and confidential. In furtherance hereof, the User agrees to;
  • Choose a new password, whenever required for security reasons.
  • Keep his/ her User ID & Password strictly confidential.
  • Be responsible for any transactions made by the User under such User ID and Password.

Payment Gateway Disclaimer
The Service is provided in order to facilitate access to view and pay Fees online. The Institute or the Payment Service Provider(s) do not make any representation of any kind, express or implied, as to the operation of the Payment Gateway other than what is specified on the Website for this purpose. By accepting/ agreeing to these Terms and Conditions, the User expressly agrees that his/ her use of the aforesaid online payment Service is entirely at the own risk and responsibility of the User.

Debit/Credit Card, Bank Account Details
1. The User agrees that the debit/credit card details provided by him/ her for use of the aforesaid Service(s) must be correct and accurate and that the User shall not use a debit/ credit card, that is not lawfully owned by him/ her or the use of which is not authorized by the lawful owner thereof. The User further agrees and undertakes to provide a correct and valid debit/credit card details.
2. The User may pay his/ her fees to the Institute by using a debit/credit card or through an online banking account. The User warrants, agrees, and confirms that when he/ she initiates a payment transaction and/or issues an online payment instruction and provides his/ her card/bank details:

  • The User is fully and lawfully entitled to use such credit/debit card, bank account for such transactions;
  • The User is responsible to ensure that the card/ bank account details provided by him/ her are accurate;
  • The User is authorizing debit of the nominated card/ bank account for the payment of fees selected by such User along with the applicable Fees.
  • The User is responsible to ensure sufficient credit is available on the nominated card/ bank account at the time of making the payment to permit the payment of the dues payable or the bill(s) selected by the User inclusive of the applicable Fee.

    System Error
    The institute nor the Payment Service Provider(s) will not take responsibility for system errors that may occur due to incomplete transaction processing, network/server errors, etc. Users are advised to always contact the institute to confirm payment and registration success. Users must ensure they get a receipt from the Institute and not just the Payment Service Provider(s) alone. Receipts from the Institute remain the only valid means of payment and registration confirmation.

Outstanding Balance and Chargebacks

An outstanding balance is incurred on a candidate's Test User account when payment made for an exam on behalf of that candidate is reversed with chargebacks. This reversal may occur at any time after a seemingly successful payment process. It is caused by a Test body's embedded payment gateways' inability to remit funds paid through the payment gateway to their respective Bank accounts thereby reversing the funds paid back to the Payee. Candidates who receive outstanding balance notifications on their user accounts are to notify us via E-mail immediately after they are notified, for possible payment re-initiation.

We require at least 7 to 10 working days to resolve outstanding balance-related issues. Under no circumstance should an outstanding balance be cleared by the candidate themselves except a go-ahead by us is given, as clearing it without our consent may lead to extra chargebacks that will be incurred by the Candidate alone. If this is the case, the Candidate will only be entitled to a refund of the initial payment made for the exam (Point 6 applies). No extra chargeback costs will be refunded to the Candidate except that of the initial fees paid by the Candidate to us for the exam registration.

Admission Processing Agreement

In consideration of the professional services to be rendered, The Candidate must agree to pay a non-refundable fee as stated on the Admission Agreement Form being the admission processing fee, payable as stated below:

  • Candidate must agree and acknowledge that the non-refundable fee as specified to pay is payable for admission processing install-mentally at 70% before the commencement of the process and 30% before the collection of I-20 to Mack IV Consult, that is, the handing over of all Admission documents.
  • Candidates must understand that the non-refundable admission processing fee charged in their case is the professional fee Mack IV Consult charges to represent him or her for admission processing into the agreed stated number of universities abroad.
  • Candidates must acknowledge and agree that the fee paid to Mack IV Consult does not guarantee that their application for admission into the agreed number of schools will be approved by the same. The Candidate’s admission is solely dependent on the school to which he or she has applied.
  • Candidates must also acknowledge and agree that their payment of the non-refundable admission processing fee allows Mack IV Consult to send their application to the agreed number of institutions stated in the agreed country or countries chosen on the admission form.
  • Candidates must understand that Mack IV Consult is not responsible for any payment(s) that He or She makes to the school(s) to which they may have applied in the likes of tuition fee or otherwise and hence cannot be held liable under any circumstances.
  • Candidate must also agree that whenever He or She has issues or complaints about their application for admission in the agreed country or countries chosen or any term of this agreement, He or She will first contact Mack IV Consult, whom He or She has appointed as their agent and seek to resolve all issues.
  • In the event that the Candidate fails to sign the Agreement or The Candidate is in arrears of payment of fees or cost, Mack IV Consult shall not be expected or required to render services.

How to Apply for a Refund

The following documentation must be submitted to enable us to process your request.

  • An E-mail requesting a refund that contains grounds for which you are demanding such.
  • We will consider requests in writing (via E-mail to services@mackivconsult.org) for refunds of unregistered Tests or Examinations on a case-by-case basis via the receipt of relevant information to determine the eligibility of a refund. Where eligible, (point 5) applies including a 10% Service Charge. Where it is established that the warranted service paid for was not provided due to our incapacity, the 10% service charge will be waived.
  • Only refund requests sent to services@mackivconsult.org will be processed.
  • The receipt or evidence of payment issued by Mack iv Consult or any of its subsidiaries.
  • Candidates' account details.

How Refunds are Addressed

  1. Refund applications take thirty to forty-five (30 – 45) days to process. You will be contacted on the outcome of your application.
  2. Refunds are treated collectively and are issued only on Fridays. Refunds shall only be issued by Bank transfer for all Payments made.
  3. Refunds shall not be issued to Third Parties.

Delivery/Shipping

It’s no secret that candidates are seeking convenience, resulting in a drive towards on-demand delivery. Candidates must allow the agreed number of days (applicable to your chosen delivery option) for their order to arrive. If more than 15 days have passed, please email or call to review the status of your order. Refunds will be handled through email if necessary.

  • Candidates must understand that the courier Delivery option “Home delivery” applies within the Stipulated state(s) we have a physical branch(es) or subsidiaries and have a delivery timeline of 24-48 hours after payment confirmation.
  • All deliveries are processed after payment confirmation.
  • Candidates who choose 3rd Party Courier service companies as their courier delivery option must be made aware that once their package is handed over to the courier service provider, we have little or no control over the status of the package aside from being able to monitor its delivery process.
  • Extra charges may apply if you choose to defer your delivery to a location different from what was previously chosen.

Returns

Our return policy lasts 30 days. If 30 days have gone by since your order was received, unfortunately, we can’t offer you a refund or an exchange.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

To complete your return, we require a receipt or proof of purchase and a reason for the return.

Please do not send your purchase back to the manufacturer.

There are certain situations where returns and exchanges are granted (if applicable).
Book with obvious signs of use, missing pages, faulty CDs, etc.
Any item not in its original condition is damaged or missing parts for reasons not due to our error.
Any item that is returned less than 15 days after delivery.

Newsletters

At the point of contact or by filling out any of our service forms either physically, or via other channels, you will be entitled to receive informational newsletters that may be found beneficial to you as you proceed with your aspirations. Reception of these newsletters is optional and can be controlled via the Newsletter mail itself. You can control your preferences for receiving them or unsubscribe from receiving them at will and at any point in time.

Promotions

These are the terms that apply to any competition, prize draw, gift-card offers, discounts, or promotions that we may run, whether on our or their websites, social media platforms, on-air, or otherwise (‘ Promotions, or “Promo”‘).
By entering a Promotion, you agree to be bound by these terms and conditions along with any other Specific Rules which relate to a Promotion. Specific Rules might include entry instructions and any other specific details, rules, or conditions relating to a particular Promotion, and might be published on our website, social media platforms, or may be found in any other media which features a Promotion. The Specific Rules will usually (but may not always) refer to these terms and conditions.

Start and end date/time

Each Promotion will start immediately (i.e. as soon as it is first promoted), unless a later start date/time is specified. The closing date/time for a Promotion will be made clear in the Specific Rules or the relevant promotional materials. All times will be based on West African time.

Entering a Promotion

Each Promotion will be open to individuals who are Customers of legal age unless the Specific Rules or other promotional materials or announcements specify differently.

In any event, our employees, agencies, freelancers, contractors (and those of any of our promotion partners, associated companies, or prize providers) and their immediate family members or households (whether related or not), and anyone else professionally involved with the relevant Promotion, are excluded from entering and from winning (‘Excluded Individual(s)‘).

To enter, follow the entry process for the relevant Promotion, which will usually be explained in the Specific Rules and/or promotional materials or announcements.

Winner selection/notification
For each Promotion, there will be only one grand prize winner unless otherwise specified.
In the case of a prize draw, the winner(s) will be selected at random, or according to the rules specified. This will be done by an automated process or a process that will be conducted or supervised by Us, or as otherwise mentioned in the Specific Rules.
If you win a prize, we will notify you days before or after the end date of the Promotion. To claim the prize, respond to the notification within the deadline set out in the Specific Rules and follow the instructions which will be provided to you.

Prizes

The prize or prizes will be as described in the relevant Specific Rules. Imagery may be for illustrative purposes only, and colours and other minor details may vary. Each prize is non-transferable, non-refundable and no cash alternative is available. If we consider it necessary or appropriate, a prize or prizes (or part thereof) might be varied or swapped for a suitable alternative which will be decided at our sole discretion. You may also be required to share your winning testimony on your private social media platforms as criteria for retrieving your prize.

If you fail to claim the prize within the time limit or fail to comply with any other instructions or time limits notified to you or provide us with incorrect or fraudulent information, you will forfeit your right to the prize. We will then select an alternative winner. You'll need proof of your ID to claim a prize.
The prize cannot be used in conjunction with other offers, promotions, or prizes.

Unless otherwise stated in the Specific Rules, you may not win more than one prize per Promotion and we reserve the right to withhold or reclaim any second or subsequent prize.

Publicity and identity of winners
If you win a prize, you may be required to take part in reasonable publicity. We may publish and publicize your name, image, social media handle and/or profile picture, and your entry, and we may refer to your association with the Promotion and/or the prize, in any and all media, worldwide, in perpetuity, for publicity and PR purposes. You may also be required to share your winning testimony on your private social media platforms as criteria for retrieving your prize.

We may carry out an interview with you via various means and we may film, record and/or photograph the interview and we may use such film, recording, and/or photograph(s) for publicity and PR purposes in any and all media, worldwide in perpetuity.

Use of your entry

By entering a Promotion or submitting a video, image, Test result/Certificate, audio file, or any other materials in relation to a Promotion (including as part of the entry process or as part of a prize) or if you tag or mention us directly or indirectly in any photo, video or content in connection with the Promotion, you agree that we can re-post, re-tweet, publicize and otherwise use that which you have submitted or content (with or without any accompanying comments and information like your handle and profile pic). You agree that we can do that via the same platform(s) that you posted or shared the submitted content, as well as via other social networks and platforms that we use, and on our websites. However, obviously, we'll never sell or charge anyone for copies of your photos, videos, or other content (without your approval). And, just to be clear, unless otherwise expressly stated in the Specific Rules, you will remain the owner of the rights (e.g. copyright) in your photo, video, or other content, but you agree not to use all or any of them in connection with a competitor of ours. You waive your moral rights in relation to the same.

You warrant and undertake (i.e. guarantee), that:
you own and control all of the rights in your entry, and you have the right to grant the rights set out in these terms and conditions and any Specific Rules;
you have obtained written consent from anyone featured or mentioned in your entry, and your entry (and our and any third party's use of it) does not and will not infringe the rights of any individual or business (including any intellectual property rights, moral rights, right to privacy, confidentiality, etc.);
your entry does not violate any applicable law or regulation;
your entry does not contain anything which is indecent, untrue, defamatory, unlawful, hateful, threatening, demeaning, inappropriate, obscene, malicious, or which is in contempt of court;
your entry will not cause any kind of harm or damage and does not (to the best of your knowledge or belief) contain any virus, malware, spyware, or similar.
You will sign such document as we reasonably request, at no cost to us, to confirm any or all of the above.
Unless otherwise stated, your entry will not be returned to you.

Data Protection
Your personal data will be collected and processed by us and the promotional partners named in the Specific Rules, as well as the prize providers, in order to administer this Prize Draw.

We will also use entrants' personal data for marketing purposes where consent has been provided. Personal data may be transferred and processed outside of the AU. Liability

If we consider that you or your entry are in breach of these terms and conditions, or if we have grounds to suspect any entrant or third party of cheating, deception, or fraudulent or unsportsmanlike conduct of any kind (including, without limitation, manipulating a Promotion, choice of the prize winner(s) or any entry), without limiting the options available to us, we reserve the right in our sole discretion (and without us incurring any liability) to disqualify any entrant, entry or person we reasonably believe to be responsible for or associated with, such activity. We also reserve the right to disqualify you from a Promotion and/or prize (without us incurring any liability) if in our reasonable opinion you conduct yourself in a way that is abusive or which exposes you or others to any medical, security, safety or similar risk whatsoever (including if you are intoxicated or abusive in any way). You agree that you will not do anything which is likely to bring us or any of our promotion partners into disrepute or which might adversely affect our reputation or the Promotion.
In no event will our total aggregate liability to you exceed the cost of the prize.

Unless otherwise expressly stated in the Specific Rules, the Promotions are in no way sponsored, endorsed, administered by, or associated with any social media platform (including without limitation Twitter, Facebook, Instagram, or YouTube). You hereby release all such social media platforms from any liability. Any questions, comments, or complaints regarding this Promotion must be directed to the Promoter only, and NOT to any social media platform.

We reserve the right to withdraw or amend any Promotion, Specific Rules, and/or these terms and conditions if we consider it necessary or appropriate to do so for reasons beyond our reasonable control or if there has been a broadcasting or printing error, etc. Any changes will be posted here and/or on our website.
When entering a Promotion or claiming a prize you must use your real name. You may be required to provide us with proof of your identity and eligibility on request. Failure to provide adequate information (or to adequately prove eligibility) may result in your disqualification and/or withholding or withdrawal of a prize.

For Promotions involving online voting, only one vote for each valid email address will be accepted. We reserve the right to disqualify any entrant making or attempting to make, multiple votes, and to disregard any votes which we, in our sole discretion but acting reasonably, consider to be suspicious or fraudulent.
You agree to keep confidential any information which you know or reasonably ought to know is confidential and which relates to us, our business, the Promotion, or prize.
If Specific Rules contain a rule which directly contradicts these terms and conditions, to the extent of that contradiction the Specific Rules will override these terms and conditions for that Promotion. Otherwise, these terms and conditions will continue to apply in their entirety.

In these terms and conditions, any Specific Rules and promotional materials, or examples are given to help illustrate some terms, they are not exhaustive and do not limit those terms in any way.
These terms and conditions, together with the relevant Specific Rules, represent the entire agreement between you and us in relation to the Promotion and the prize. The invalidity, illegality, or unenforceability of the whole or any part of the terms and conditions or any Specific Rules does not affect the remainder of these terms and conditions or any Specific Rules, which will remain in full force and effect. These terms and conditions and the Specific Rules do not create any right or benefit enforceable by any third party.

The Promotion, and these terms and conditions, are governed by law, and any disputes arising in connection with them shall be subject to the exclusive jurisdiction of the Law.
